1. Who we are

DividendAtlas is operated by Dividend Atlas, a trademark of Atlas Hosting, registered with the Dutch Chamber of Commerce (KvK) under number 98785842, with its registered office at Battutalaan 759, 3526VT Utrecht, Netherlands. Our office is not open to the public; visits by appointment only.

In these Terms, “we”, “us”, and “our” refer to the operator of DividendAtlas identified above; “you” refers to the person using the service. The person responsible for the content of this service is Luck Slijpen. You can reach us at any time at support@dividendatlas.com.

2. About these Terms

These Terms of Service (the “Terms”) govern your access to and use of the DividendAtlas website, applications, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

These Terms are written for consumers, individuals acting for purposes outside their trade, business, craft, or profession. Nothing in these Terms limits or excludes any right you have under mandatory Dutch or European Union consumer law. Where a provision in these Terms conflicts with a mandatory consumer-protection rule, that mandatory rule prevails.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service, you confirm that you meet these requirements. The Service is intended for users in the European Economic Area; we make no representation that it is appropriate or available for use elsewhere.

4. What DividendAtlas is

DividendAtlas is an information and portfolio-tracking tool for dividend investors. It lets you import portfolio data, view dividend history and forecasts, fundamental metrics, allocation breakdowns, and event notifications, and research listed securities.

On the paid plan you can optionally connect a supported brokerage account so your holdings and transactions import automatically. This connection is provided through our partner SnapTrade (operated by SnapTrade, Inc.) and is strictly read-only: it lets us retrieve your holdings and transaction history, and it cannot be used to place trades, move money, or make any change to your brokerage account. You authorise the connection through SnapTrade, your use of SnapTrade is also governed by SnapTrade’s own terms and privacy notice, and you can disconnect it at any time from your account settings. We are not responsible for your broker or for SnapTrade, and connecting a broker does not make us a party to your relationship with your broker.

The Service does not execute trades, hold your assets, or transact on your behalf.

5. No financial advice

Important: please read

DividendAtlas provides factual financial information and analytical tools only. It does not provide investment advice, personal recommendations, portfolio management, or any other regulated investment service, and nothing on the Service should be understood as a recommendation, solicitation, or offer to buy, sell, or hold any security.

We are not authorised or regulated as an investment firm and do not carry out any investment service or activity within the meaning of the EU Markets in Financial Instruments Directive (MiFID II). Information presented is general in nature and does not take account of your individual circumstances, objectives, or risk tolerance.

You are solely responsible for your investment decisions. Investing carries risk, including the loss of capital, and past performance is not a reliable indicator of future results. We strongly recommend you seek advice from a qualified, independent professional before making any investment decision.

6. Data accuracy and third-party sources

Market data, prices, dividend history and forecasts, fundamental data, and calendar events are sourced from third-party providers and our own processing of that data. Prices are delayed (not real-time) and forecasts are estimates that may not occur. Such information may contain errors, omissions, or delays.

We take reasonable care in presenting the Service, but to the extent permitted by law we make no warranty that any data is accurate, complete, current, or fit for a particular purpose. You should verify any figure that matters to you against an authoritative source before relying on it.

7. Your account

To use most features you must create an account. You are responsible for keeping your login credentials secure and for all activity under your account. You must not share your credentials, impersonate another person, or let anyone else use your account. Tell us promptly at support@dividendatlas.com if you believe your account has been compromised.

8. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in breach of these Terms;
  • copy, scrape, redistribute, resell, or commercially exploit data obtained from the Service, except where expressly permitted (for example, exporting your own portfolio data);
  • attempt to gain unauthorised access to the Service, other accounts, or our systems, or interfere with their normal operation;
  • introduce malware, place an unreasonable load on the Service, or circumvent any access, rate-limit, or security measure;
  • use automated means to access the Service in a way not expressly permitted by us.

9. Plans, pricing and billing

DividendAtlas offers a free plan and a paid plan. The paid plan is billed monthly or annually. Current prices, including any applicable VAT, are shown on our pricing page and confirmed before you pay. Prices may change; we will give you reasonable advance notice of any change affecting your subscription, and any new price will apply only from your next renewal.

Payments are processed by our payment provider, Stripe. By subscribing you authorise us, through Stripe, to charge your chosen payment method for the applicable fees. We do not store your full card details.

10. Renewal and cancellation

Subscriptions renew automatically at the end of each billing period (monthly or annual) unless you cancel beforehand. You can cancel at any time from your account settings; cancellation stops future renewals.

For a monthly subscription, cancellation takes effect at the end of the current monthly period. For an annual subscription, after the initial twelve-month term the subscription continues on a rolling basis and you may cancel at any time, with cancellation taking effect no later than one month after you give notice. When a subscription ends, your account reverts to the free plan; paid-only features and data beyond the free plan’s limits become unavailable until you subscribe again.

11. Right of withdrawal and immediate access

As a consumer you normally have the right to withdraw from a distance contract within 14 days without giving a reason. Because the paid plan is a digital service that we make available to you immediately, the following applies when you subscribe:

  • you expressly request that we begin providing the paid Service straight away, during the 14-day withdrawal period; and
  • you acknowledge that, once we have begun providing the paid Service with your consent, you lose your right of withdrawal for that billing period.

You can still cancel future renewals at any time as described in section 10. We do not generally provide refunds for a billing period once paid access has begun, except where required by mandatory law or where we decide to do so at our discretion. This does not affect your statutory rights where the Service is faulty or not as described.

12. Intellectual property

The Service, including its software, design, text, and branding, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use in accordance with these Terms. You retain ownership of the portfolio data you upload; you grant us the rights needed to process and display it so we can provide the Service to you.

13. Availability and changes

We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may update, change, or discontinue features. If we make a significant change that materially reduces the paid Service to your disadvantage, you may cancel and, where required by law, receive a refund for the unused part of any prepaid period.

14. Suspension and termination by us

We may suspend or terminate your access if you materially breach these Terms, if required by law, or to protect the Service or other users. Where the circumstances allow, we will give you notice and an opportunity to remedy the breach. If we terminate without cause, we will refund any prepaid fees for the period after termination.

15. Our liability to you

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • our intent or gross negligence (opzet of bewuste roekeloosheid); and
  • any liability that cannot be limited or excluded under mandatory law.

Subject to the above, and because DividendAtlas is an information tool and not a source of financial advice, we are not liable for any investment decision you make or for losses arising from your reliance on data or forecasts presented through the Service. To the extent permitted by law, we are not liable for indirect or consequential loss, and our total liability arising from or in connection with the Service is limited to the fees you paid to us in the twelve months before the event giving rise to the claim (or €100 if you use the free plan).

16. Privacy

We process your personal data in accordance with the General Data Protection Regulation (GDPR). How we collect, use, and protect your data is explained in our Privacy Policy, which forms part of your agreement with us.

17. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will notify you by a reasonable means (for example, by email or an in-app notice) before it takes effect. Minor or legally required changes may take effect immediately. The “last updated” date above always reflects the current version. If you do not accept a material change, you may cancel your subscription before it takes effect.

18. Complaints and disputes

If you have a complaint, please contact us first at support@dividendatlas.com so we can try to resolve it. If we cannot resolve it together, you may bring the matter before the competent court. As a consumer, you may be entitled to use an alternative dispute resolution body and to bring proceedings before the courts of your country of residence within the European Economic Area.

19. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands. If you are a consumer resident in another EEA country, you keep the protection of any mandatory consumer-protection rules of your country of residence, and you may bring proceedings in the courts of that country where those rules allow. Otherwise, disputes are subject to the jurisdiction of the competent Dutch courts.

20. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours to a successor of our business, provided your rights are not reduced. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
